Terms of Service

1. Acceptance of Terms
By accessing or using Himetrica ("the Service"), operated by Yeloy Tecnologia LTDA (CNPJ No. 67.197.218/0001-59, "Himetrica," "we," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms apply to all visitors, users, and others who access the Service.
2. Account Registration & Responsibilities
To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
3. Acceptable Use
You agree not to misuse the Service. This includes, but is not limited to: attempting to access another user's account, interfering with or disrupting the Service, using the Service for any unlawful purpose, transmitting malicious code, or scraping data from the Service without authorization. We reserve the right to suspend or terminate accounts that violate these terms.
4. Rate Limiting & API Abuse
To ensure the stability and availability of the Service for all users, Himetrica enforces rate limits on all API and tracking endpoints. These limits are documented in our Server API documentation. You agree not to:
- Exceed or attempt to circumvent published rate limits
- Use automated tools to generate excessive or artificial traffic to the API or tracking endpoints
- Send fake, fabricated, or inflated analytics data (e.g. spoofed page views, synthetic events, or bot-generated sessions)
- Reverse-engineer, probe, or stress-test the Service infrastructure without prior written authorization
- Share, redistribute, or resell API keys or allow third parties to use your keys
- Use the Service to relay, proxy, or aggregate data on behalf of other analytics platforms
If we detect abuse, we may throttle, suspend, or terminate your access without prior notice. Repeated or egregious violations may result in permanent account termination and forfeiture of any prepaid fees. We reserve the right to block IP addresses, API keys, or accounts engaged in abusive behavior at our sole discretion.
5. Intellectual Property
The Service, including its original content, features, and functionality, is owned by Himetrica and is protected by international copyright, trademark, and other intellectual property laws. You retain ownership of any data you submit to the Service. By using the Service, you grant us a limited license to process your data solely to provide and improve the Service.
6. Data & Privacy
Your privacy is important to us. Please review our Privacy Policy for information on how we collect, use, and protect your data. By using the Service, you consent to the collection and use of information as described in our Privacy Policy.
Where Himetrica processes personal data on your behalf as your data processor (for example, data about your end users and visitors), our Data Processing Agreement applies and is incorporated into these Terms by reference. By accepting these Terms and using the Service, you also accept that agreement, and no separate signature is required.
7. Your End Users' Data & Consent
When you install our tracking script or use our APIs, Himetrica collects data about the visitors and end users of your website or application on your behalf. Depending on the features you enable, this data may include:
- Pseudonymous visitor and session identifiers
- Pages visited, referrer URLs, and campaign parameters (UTM)
- Device information such as screen size and user agent
- Approximate location derived from the IP address (country, region, city)
- Custom events, performance metrics, and error reports, when enabled
- Name, email address, and other attributes you choose to provide through the identify API
- Customer, charge, and subscription data imported when you connect a revenue or payment integration
As between you and Himetrica, you are the data controller of this data and Himetrica processes it as your processor under our Data Processing Agreement. You are solely responsible for complying with all applicable privacy and data protection laws (including the LGPD and, where applicable, the GDPR) with respect to your end users. In particular, before using the identify API or any feature that associates analytics data with an identified or identifiable person (such as a name, email address, or user ID), you must have obtained that person's consent or established another valid legal basis, and you must disclose your use of Himetrica in your own privacy policy. You must not send us sensitive personal data, data about children where prohibited, or any data you do not have the right to share.
8. Third-Party Services & Integrations
The Service offers optional integrations with third-party services. When you enable an integration (for example, an advertising integration such as the Meta Conversions API, or a payment-provider integration), you authorize Himetrica to transmit the relevant data to that third party so the integration can function. That data is then processed by the third party under its own terms and privacy policy, and Himetrica is not responsible for the practices of any third-party service. You are responsible for ensuring you have any rights and consents required to enable an integration and to send the associated data.
9. Payment & Billing
Himetrica offers Free, Pro, and Business plans. Paid plans are billed on a monthly or annual basis. You agree to pay all fees associated with your selected plan. Fees are non-refundable except as required by law. We may change our pricing with 30 days' notice. If payment fails, we may suspend access to paid features until payment is resolved.
10. Data Retention
Detailed analytics data (individual page views, events, sessions, web vitals, and frontend errors) is subject to retention limits based on your subscription plan. Data older than your plan's retention period may be permanently deleted. Aggregate daily summaries (traffic totals, top pages, traffic sources, geographic breakdowns, and event counts) are preserved beyond the retention period, ensuring your historical trends and dashboard charts remain available. Individual session details, visitor activity timelines, and event properties beyond the retention window will no longer be accessible. Upgrading your plan extends the retention period for all existing detailed data. Visitor profiles are not subject to retention limits and are kept for the lifetime of your account.
11. Termination
We may terminate or suspend your account at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. You may also delete your account at any time through your account settings. We will make reasonable efforts to allow you to export your data before account deletion takes effect.
12. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. To the maximum extent permitted by law, Himetrica disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that analytics data will be complete or accurate. You use the Service at your own risk.
13. Limitation of Liability
To the maximum extent permitted by law, Himetrica shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service. Our total liability for any claim arising out of or relating to these terms shall not exceed the amount you paid us in the 12 months preceding the claim.
14. Indemnification
You agree to indemnify, defend, and hold harmless Himetrica and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Service, your violation of these terms (including Sections 3, 4, and 7), or your violation of any rights of a third party, including in connection with any integration you enable or data you send through the Service.
15. General
If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. These terms, together with our Privacy Policy and, where applicable, our Data Processing Agreement, constitute the entire agreement between you and Himetrica regarding the Service and supersede any prior agreements. You may not assign or transfer these terms without our prior written consent; we may assign them without restriction. Our failure to enforce any right or provision of these terms will not be considered a waiver of that right. Himetrica will not be liable for any failure or delay in performance resulting from causes beyond its reasonable control.
16. Governing Law & Jurisdiction
The Service is operated by Yeloy Tecnologia LTDA, a company registered in Brazil under CNPJ No. 67.197.218/0001-59. These terms are governed by and construed in accordance with the laws of the Federative Republic of Brazil, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these terms or the Service shall be subject to the exclusive jurisdiction of the courts of the judicial district (comarca) of the Company's registered headquarters, and you waive any objection to such venue, to the extent permitted by law.
17. Changes to Terms
We reserve the right to modify these terms at any time. When we make changes, we will update the version number and effective date at the top of this page. Your continued use of the Service after changes are posted constitutes your acceptance of the updated terms. We will notify you of material changes via email or through the Service.
